Christopher Chibwana, a Director of a Mining Company Arrested for US$5m Fraud

Christopher Chibwana a director of a mining company has been arrested and charged with unlawfully transferring ownership of his deceased partner’s stake in the company. As a result, the director is facing legal action.

Christopher Chibwana (age 51) made an appearance before Taurai Manuwere, the Harare magistrate, to answer to two charges of fraud and one of perjury. The state claims that a significant amount of US$5 million is involved in the fraud.

As per Anesu Chirenje, the prosecution, Stephen Chiparawasha, the departed partner, was the owner of Ascot Mine 20, a mining claim located in Norton. Following Chiparawasha’s death in 2012, Chibwana allegedly oversaw the unauthorised sale of the mine.

The mining claim was allegedly moved from MAWK (Pvt) Ltd, where Chiparawasha was a shareholder, to JnYang Htson MAWK (Pvt) Ltd, a business in which his late co-director had no shares, according to Chirenje’s allegations that Chibwana had rigged the transfer procedure.

In November 2016, Chibwana is said to have approved the transfer of the mining certificate to his own business through the use of a fictitious special power of attorney.

A fraudulent CR14 document that Chibwana created for MAWK Mining Development Company in October 2018 and January 2020, erroneously designating himself as the company secretary, is one of the additional charges against him. This action was allegedly intended to change the organisation of the corporation to his benefit.

In addition, Chibwana is charged with perjury for allegedly lying to the High Court on June 8, 2021, while testifying under oath. He allegedly filed an affidavit attempting to obstruct access to the mining site in an effort to defraud Chiparawasha’s estate.
