Court Orders Husband to Settle US$32,500 Debt to Ex-Wife After Divorce

Harare, Zimbabwe | A woman is set to receive US$32,500 as part of a settlement following her divorce from her husband of 10 years.

Letwin Kadiyo made the claim based on a tacit universal partnership she had with her ex-husband, Kudakwashe Naison. The couple’s journey began in 2013 when they met at the Gulf Complex in Harare, where Letwin sold shoes and Kudakwashe was in the cellphone business.

Their relationship quickly blossomed, and they began living together in 2014. In 2015, Letwin became pregnant with their first child, which led her to stop working and invest US$500 of her savings into Kudakwashe’s cellphone business. As the business began to turn a profit, the couple moved to the Avenues area, renting a flat and securing a US$35,000 loan in cellphones from a Chinese supplier.

Throughout their marriage, they also purchased a property in Haydon Park, which they later sold for US$65,000, and a Honda Fit.

However, their relationship faced challenges, leading to their separation in March 2023. Letwin walked away with nothing from the split, though she claimed she left behind nearly US$40,000 in stock from the cellphone business, for which she argued she should receive half the share.

Kudakwashe, on the other hand, denied that they were in a business partnership and asserted that he was still repaying a loan to their Chinese contact. He claimed that during the separation, he left Letwin with the Honda Fit and had even set up a business selling hair weaves for her.

In response, Justice Emy Tsanga ruled that even if the court accepted that there was no formal business partnership, Kudakwashe could not disregard the fact that Letwin had a rightful claim to half of their jointly owned property. She emphasized that he could not use Letwin’s share from the sale of the property to settle his business debt.

The judge ordered Kudakwashe to pay Letwin US$32,500 as her half share of the proceeds from the sale of the Haydon Park property, which measured 877 square meters. Kudakwashe was instructed to make the payment within six months or within an alternative period agreed upon by both parties in writing
