Ivy Kombo and Husband Cry Foul Over Fraud Trial, Write to the NPA
Attorneys representing gospel musician Ivy Kombo and her husband, Admire Kasi, who are accused of obtaining conversion certificates to practice law in Zimbabwe without undergoing the required examinations, have lodged a complaint with the National Prosecuting Authority regarding the conduct of the trial prosecutor.
The prosecutor, Anesu Chirenje, made an attempt to introduce a piece of evidence during the recent trial that had been previously rejected by the court. The attorneys representing the accused couple viewed this as an effort to clandestinely insert evidence into the court record.

Expressing their discontent, the lawyers argued that such actions could prejudice their clients, who were preparing and presenting their defense without access to this particular evidence.
In a letter addressed to the prosecutor, Admire Rubaya, the legal representative for the Kombo couple, stated:
“We write to express our deep concern over your recent attempt to introduce an email extract into the trial proceedings, which we find highly disturbing as it appears to constitute an unethical and improper attempt to insert this document into the record.”
“We categorically reject your efforts to serve this document in this manner. The State had previously provided us with an affidavit containing only one annexure, which was a schedule, not an email extract.”
Rubaya continued:
“It is troubling that your failure to produce this crucial email extract, which you now seek to rely on, reflects a significant lapse in diligence. Your oversight in not providing this evidence earlier was negligent at best. Attempting to introduce it at this late stage is unfair, unlawful, and contrary to proper procedure.”

“We maintain that your role as a public prosecutor should not be exploited to unfairly disadvantage our client based on the delayed disclosure of evidence prior to the trial.”
The attorneys representing Ivy Kombo and Admire Kasi are adamant that the integrity of the trial process must be upheld, and they are determined to ensure that their clients receive a fair and just hearing in accordance with the principles of justice and due process.
