Man Seeks US$45,000 in Damages Over Wife’s Adulterous Affair

A man is seeking US$45,000 in damages from his wife’s alleged lover, claiming emotional and social harm due to an affair. Vincent Chiwawa has filed a suit against Alfos Bukhosibethu Nyathi, an employee at the Environment Management Agency (EMA) based in Plumtree, for his involvement in the affair with Chiwawa’s wife, Christian Kagande.

The couple, married since 2010, had plans to relocate to the UK, with Vincent assisting his wife in preparing her migration papers. However, Christian confessed to infidelity in November 2024, revealing that she had been involved with Nyathi from 2020 to 2024, even while Vincent was in Zimbabwe and after he had moved to the UK.

Chiwawa sought a default judgment after Nyathi failed to respond to legal summons, and the court granted the application. In his legal claim, Vincent is asking for US$45,000 in damages for emotional distress, loss of companionship, and damage to his reputation.

The couple, who have two children aged 14 and 11, were married under the Marriage Act in March 2021. The affair deeply affected their family, with the children witnessing the breakdown of their parents’ relationship. The children also experienced social strain, with their school grades declining as they became the subject of gossip due to the affair.

Vincent claims that the affair damaged his social standing, both personally and professionally, especially as the affair became widely known in their small town. He further alleges that Nyathi’s actions took away the warmth and intimacy he once shared with his wife, leaving him emotionally and socially devastated.
