Harare | Sengezo Tshabangu, a controversial politician, is being represented by Lewis Uriri, the attorney for President Emmerson Mnangagwa, in a case involving 14 opposition Members of Parliament (MPs) who are appealing their recall from parliament.
Mnangagwa was defended by attorney Uriri in the 2018 presidential contest.
At the request of Tshabangu, who proclaimed himself the party’s acting secretary general, the lawmakers were brought back into session.
The impacted MPs filed a recall challenge with the High Court, arguing that Tshabangu lacked the authority to start recalls because he is not a member of the CCC.
They want the announcement of vacancies in the impacted constituencies, which was made by Speaker of Parliament Jacob Mudenda, to be overturned.
Judge Munamato Mutevedzi of the High Court committed to declaring the decision by November 7, the day the nomination court is scheduled to convene.
Several of the impacted MPs were represented by attorney Amanda Sihle Ndlovu, who announced that their case had been successfully filed with the court.
“It was a protracted struggle, involving numerous legal experts to arrive at our current position.
“The situation is now safely in the hands of the courts, and we have been guaranteed a decision before the nomination court sits, which is very crucial to us as it will dictate our next course of action,” the woman stated.
Harmonised general elections were held in Zimbabwe on August 23 and 24 of this year. Tshabangu appeared shortly after the plebiscite and declared himself to be the party’s acting secretary general. He then wrote to Mudenda and said he was recalling fourteen CCC Members of Parliament.
Mudenda declared vacancies in the impacted constituencies and supported Tshabangu’s letter.
After that, Mnangagwa published Proclamation 8 of 2023, Statutory Instrument 188 of 2023, which set November 7 as the date of the nomination court meeting and December 9 as the date of the by-elections.
According to the opposition, Tshabangu is being supported by Zanu-PF in his effort to recall CCC MPs in order to increase his parliamentary seat total and secure a two-thirds majority.
